Operator: Sailor Pty Ltd (sailor.com.au)
1. About these terms

These Website Terms of Use govern your access to and use of the Sailor website, including any enquiry forms, quote request forms, contact forms, downloadable material, email links, uploaded documents, and related website features made available through this website.
By accessing or using this website, you agree to these terms. If you do not agree, you must not use this website.
2. Who we are

Sailor is a professional yacht delivery and owner-support business. We provide services directly through Sailor Pty Ltd using Sailor’s own employees, contractors, Masters, skippers, and crew engaged by Sailor for the purpose of delivering or supporting a vessel, owner, buyer, or related project.
Sailor is not a public talent marketplace, crew directory, ratings platform, or forum.
3. Website information only

Unless expressly stated otherwise in writing, content on this website is provided for general information only. Material on the website may describe typical service scope, operating approach, weather planning, vessel-readiness issues, indicative processes, and general risks, but it is not a substitute for a written proposal, booking confirmation, or tailored professional advice for your vessel and route.
A service is only offered or accepted when Sailor issues a written proposal, quotation, or booking confirmation and it is accepted in the manner required by Sailor.

4. Enquiries and quote requests

If you submit an enquiry, request a quote, upload documents, or otherwise provide information through the website, you warrant that the information you provide is accurate, current, and not misleading.
You must not submit information on behalf of another person or entity unless you are authorised to do so.
Submission of an enquiry or quote request does not oblige Sailor to accept the work or provide services.
5. Information we collect through the website

By using the website or submitting forms to us, you acknowledge that Sailor may collect information including:
your name, contact details, and business details;
vessel details, location, specifications, route, timing, and condition information;
supporting documents, photographs, certificates, inventories, and survey-related information;
communications you send to us; and
website usage data, analytics, and cookie-related data.
This information is handled in accordance with our Privacy Policy.

6. How we use submitted information

You authorise Sailor to use information submitted through the website for legitimate business purposes connected with:
assessing whether Sailor can provide services;
preparing estimates, proposals, and delivery plans;
internal operational review;
safety, compliance, credential verification, and service delivery;
communicating with you about the proposed or booked work; and
engaging and briefing Sailor personnel, employees, and contractors who need the information to assess or perform the services.
Where reasonably necessary for the services, Sailor may also share relevant information with insurers, brokers, ports, marinas, surveyors, technical advisers, transport or travel providers, regulators, professional advisers, and customers involved in the engagement.

7. Sailor personnel and credentials

Sailor may collect, hold, verify, and use information about its employees and contractors, including qualifications, experience, licences, certificates, references, identity documents, and work history, for recruitment, compliance, insurance, operational, and service-delivery purposes.
Where relevant to a proposed or booked engagement, Sailor may disclose appropriate credential and experience information about Sailor personnel to a customer, prospective customer, broker, insurer, or other legitimate stakeholder so that they can assess suitability for the engagement.

8. Acceptable use

You must not use this website:
for unlawful, misleading, fraudulent, or malicious purposes;
to interfere with the operation or security of the website;
to attempt unauthorised access to systems, data, or other users’ information;
to submit false, defamatory, infringing, obscene, or harmful content;
to scrape, harvest, or copy website content or data by automated means without Sailor’s written consent;
to impersonate another person or misrepresent your authority.

9. Intellectual property

Unless otherwise stated, the website and its content, including text, design, graphics, images, logos, layouts, documents, and branding, are owned by or licensed to Sailor.
You may view the website for personal or internal business use connected with evaluating Sailor’s services. You must not reproduce, modify, publish, distribute, commercialise, or create derivative works from website content without Sailor’s prior written consent.

10. Third-party links and resources

The website may contain links to third-party websites or services. Those links are provided for convenience only. Sailor does not control and is not responsible for third-party websites, content, products, or services.

11. Website availability

Sailor does not guarantee that the website will be uninterrupted, secure, error-free, or free from harmful code. We may suspend, withdraw, change, or update the website at any time without notice.

12. No warranties about website content

To the maximum extent permitted by law, Sailor makes no representation or warranty that website content is complete, current, accurate, suitable for your circumstances, or free from errors or omissions.
Because yacht delivery work is highly dependent on vessel condition, route, weather systems, timing, regulatory requirements, crewing, and owner disclosures, any general information on this website must not be relied on as a fixed commitment or final statement of scope, timing, availability, price, or outcome.

13. Limitation of liability

To the maximum extent permitted by law, Sailor excludes liability for any loss, damage, cost, or expense arising from or in connection with:
your use of or inability to use the website;
reliance on website content;
errors, omissions, interruptions, delays, or viruses;
third-party sites or services linked from the website; and
unauthorised access to or alteration of transmissions or data.
Nothing in these terms excludes rights that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Where liability cannot be excluded, Sailor’s liability is limited to the maximum extent permitted by law.

14. Indemnity

You indemnify Sailor against claims, loss, damage, liability, cost, and expense arising from your breach of these terms, your misuse of the website, or information or material you submit that is false, misleading, unlawful, or infringes another person’s rights.

15. Privacy

Your use of the website is also subject to Sailor’s Privacy Policy.

16. Changes to these terms

Sailor may amend these Website Terms of Use from time to time by publishing an updated version on the website. The updated version takes effect when published.

17. Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and courts hearing appeals from them.
